Hereinafter referred to as « Les Toqués du Fromage ».

2. PURPOSE

These General Terms and Conditions of Sale (GTC) govern the services provided by Les Toqués du Fromage to individuals, companies, associations, and local authorities.

The services include in particular:

• Cheese tasting workshops;

• Cheese-related events and animations;

• Cheese and beverage pairings;

• Catering services;

• Creation of cheese platters;

• Buffets and receptions;

• Tailor-made services.

Any order implies the unreserved acceptance of these GTC.

3. ORDERS

Orders can be placed by phone, email, contact form, or quote.

Any service is subject to a quote specifying:

• The nature of the service;

• The date;

• The location;

• The number of participants;

• The pricing conditions.

The order becomes firm and final upon receipt of the quote signed by the client.

The client undertakes to provide any information useful for the proper execution of the service, in particular regarding:

• Allergies;

• Food intolerances;

• Specific diets;

• The presence of pregnant women.

4. PRICING

Prices are expressed in euros.

The prices indicated on the quotes are exclusive of tax or inclusive of all taxes, depending on the status of the client and the information stated on the quote.

Any change in the legal VAT rate will automatically be reflected in the prices.

Travel, parking, accommodation, or specific equipment rental costs may be subject to additional billing as mentioned in the quote.

5. PAYMENT TERMS

Unless otherwise specified on the quote:

• A 50% deposit (inclusive of tax) is required at least 10 days before the service;

• The balance is payable within 30 days following the date of the service.

Payments can be made by:

• Bank transfer;

• Credit card;

• Any other method accepted by Les Toqués du Fromage.

In the event of non-payment, Les Toqués du Fromage reserves the right:

• To suspend or cancel the service;

• To refuse any new order;

• To initiate any useful debt recovery proceedings.

For professional clients: Any amount not paid by the due date will automatically entail the application of late payment penalties calculated on the basis of three times the legal interest rate, as well as a flat-rate indemnity of €40 for recovery costs in accordance with Article L.441-10 of the French Commercial Code.

6. MODIFICATION OF THE SERVICE

Any request for modification must be made in writing.

Modifications are accepted subject to feasibility.

No modification can be guaranteed less than 10 working days before the event.

Any major modification may result in a revision of the quote.

7. POSTPONEMENT

The client may request a postponement of the service.

The request must be made in writing at least 10 working days before the scheduled date.

Postponements requested less than 10 working days before the service may incur a 15% surcharge on the total amount (inclusive of tax) of the service.

Postponement remains subject to the availability of Les Toqués du Fromage.

8. CANCELLATION

Any cancellation must be sent in writing to: hello@lestoquesdufromage.com

Cancellation more than 10 working days in advance: Billing of 10% of the total amount (inclusive of tax).

Cancellation less than 10 working days in advance: Billing of 100% of the total amount (inclusive of tax).

9. MINIMUM NUMBER OF PARTICIPANTS

Certain services require a minimum of 8 participants.

Les Toqués du Fromage reserves the right to refuse a booking that does not meet this threshold.

10. CLIENT’S RESPONSIBILITY

The client guarantees the accuracy of the information provided.

They are responsible for:

• Respecting the schedule;

• Access to the premises;

• Obtaining necessary authorizations;

• Site safety conditions when hosting the event.

11. ALCOHOL AND PROTECTION OF MINORS

When the service includes an alcoholic beverage tasting, this is strictly reserved for adults of legal drinking age.

The client undertakes to comply with current regulations.

Les Toqués du Fromage cannot be held liable for alcohol consumption that is contrary to the law.

12. IMAGE RIGHTS

Photographs or videos may be taken during the services.

Unless there is prior written objection from the participant or the client, Les Toqués du Fromage is authorized to use these images for:

• Communication;

• Promotion;

• Publication on social media;

• Commercial presentations.

No compensation may be claimed in this regard.

FORCE MAJEURE

Neither party can be held liable for a delay or non-performance resulting from a case of force majeure.

The following, in particular, are considered cases of force majeure:

• Natural disasters;

• Pandemics;

• Fires;

• General strikes;

• Power outages;

• Administrative decisions;

• Inability to access the service location.

13. PERSONAL DATA

The personal data collected is used exclusively for:

• Order management;

• Billing;

• Customer relationship management;

• Legal obligations.

Data is kept for the duration necessary for its processing.

In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés), the client has:

• A right of access;

• A right to rectification;

• A right to erasure;

• A right to object;

• A right to restriction of processing.

14. CONSUMER MEDIATION

In accordance with the provisions of the French Consumer Code, any consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute.

The contact details of the competent mediator will be provided upon simple request or will appear on the company’s website.

15. APPLICABLE LAW AND DISPUTES

These GTC are subject to French law.

In the event of a dispute, the parties will primarily seek an amicable solution.

Failing an amicable agreement, the competent courts shall be those within the jurisdiction of the Court of Appeal of Lyon, subject to applicable protective provisions for consumers.
